Blood Pressure Log & Reports: Terms of Use

These terms are the agreement between you and Setout Labs LLC, a Delaware limited liability company ("we"), for the iPhone app Blood Pressure Log & Reports. By using the app you accept them. If you do not accept them, do not use the app. You must be at least 13 years old, or the minimum age where you live to consent to online services, to use the app. The app is licensed to you under Apple's standard Licensed Application End User License Agreement; these terms add to it.

Not a medical device

The app is a diary. You take your blood pressure with your own cuff or monitor and type the numbers in. The app does not measure blood pressure, and your iPhone cannot measure it.

The app does not diagnose, treat or prevent any condition, and it does not give medical advice. It is not a medical device. Averages, charts and reports only summarize what you entered. Always talk to your doctor or another qualified health professional about your readings and before changing any treatment.

In an emergency, or if you feel unwell, call your local emergency number right away. Do not wait on the app.

Your readings

Your readings belong to you and stay on your iPhone. There is no account and no cloud backup, so if you delete the app or lose your iPhone, your history may be lost. Export a report from time to time if you want to keep a copy. You are responsible for entering readings accurately and for the reports you share. How we handle data is described in our privacy policy.

Free features and Pro

Logging readings, full history, basic trends, the basic doctor report (PDF) and the full CSV export are free. Pro adds reminders, custom date ranges and filters, and detailed report options.

Pro is sold through the App Store as a monthly subscription, a yearly subscription, or a one-time lifetime purchase. The price is shown in the app and by Apple before you confirm.

  • Monthly and yearly subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends. Your Apple ID is charged for the renewal.
  • To manage or cancel a subscription, open the iPhone Settings app, tap your name, then Subscriptions. Deleting the app does not cancel it.
  • The lifetime option is a single payment and does not renew.
  • Payments and refunds are handled by Apple under its policies. Request a refund at reportaproblem.apple.com.
  • If you reinstall the app or get a new iPhone, use Restore Purchases in the app's Settings.
  • If Pro ends, you can still read and export all of your existing readings.

Acceptable use

Do not use the app to break the law or infringe anyone's rights, reverse engineer it, or get around its technical limits or security.

Our content

The app and its software, design and branding belong to Setout Labs LLC or our licensors. We grant you a personal, non-exclusive, non-transferable, revocable licence to use it as intended. Nothing else is granted.

Availability and changes

We may change, suspend or discontinue any part of the app, and we may update these terms. For material changes we will give reasonable notice. Continuing to use the app after a change means you accept it.

Disclaimer and liability

The app is provided "as is" and "as available", without warranties of any kind to the fullest extent the law allows. We do not promise it will be uninterrupted, error-free or free of data loss. We are not liable for indirect, incidental or consequential loss, or for lost data. Where liability cannot be excluded, our total liability is limited to the greater of the amount you paid for the app in the 12 months before the event giving rise to the claim, or USD $50. Nothing here limits liability for fraud, death or personal injury caused by our negligence, or any other liability that cannot lawfully be limited. Some places do not allow these exclusions, so parts may not apply to you.

Apple

Apple is not a party to these terms and is not responsible for the app or its support. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules, except where mandatory law in your country of residence requires otherwise. Disputes will be resolved exclusively in the state and federal courts located in Delaware, except where the law gives you the right to bring a claim in your local courts. Nothing here limits consumer-protection rights that cannot be waived by contract.

General

If a provision is unenforceable, the rest stays in force. Our not enforcing a term is not a waiver of it. You may not assign these terms; we may assign them to a successor of our business.
